Is a safety committee or a worker safety representative required in Kyrgyzstan?
Part of: Occupational safety and health in Kyrgyzstan: law, authorities and employer duties
Short answer
Yes. Kyrgyz Law No. 82 of 2026 (Art. 17) requires a joint labour protection commission in the organisation, with no headcount threshold, and its decisions bind the employer. Trade unions control OSH through elected authorised persons and public inspectors (Arts. 23, 24).
Yes, both exist in Kyrgyz law. Article 17 of the Law "On Labour Protection" No. 82 of 2026 says a commission (committee) on labour protection is created in the organisation, with equal numbers of employer and trade union or other worker representatives, and its decisions bind the employer and the workers; the law sets no headcount threshold. Worker representation runs through trade unions, which may elect authorised (trusted) persons for labour protection and public inspectors with rights of inspection (Articles 23 and 24).
Short answer
- Commission (committee): Law No. 82, Article 17. Created in the organisation on a parity basis (employer and trade union or other representative body); its stated purpose is the investigation and recording of workplace accidents and occupational diseases; its decisions are binding.
- Its regulation: to be approved by the labour policy ministry together with the trade union body. None under the 2026 law was found in the official database in November 2026, so agree the commission's rules locally until it appears.
- Worker representatives: trade unions or other representative bodies carry out public control of labour protection and may set up a technical labour inspection and elect authorised (trusted) persons for labour protection (Article 23).
- Rights: check compliance, carry out independent expert reviews of working conditions, take part in accident investigations, receive information on all accidents, submit demands that the employer must consider, and ask the state body to suspend dangerous work (Article 23(2)).
- Public inspectors: may check compliance without hindrance; the employer pays for their training and releases them from work for the time set in the collective agreement on average pay (Article 24).
How the commission and union control work
The Kyrgyz model, shared with most post-Soviet countries, rests on two pillars. The joint commission brings management and workers together; under the 2026 law its explicit job is accident and occupational disease investigation and recording, and in practice it also reviews conditions and the labour protection part of the collective agreement. Members of commissions and union authorised persons must themselves be trained in labour protection under the 2004 training regulation, and the accident regulation of 2001 puts a trade union or other worker representative on every accident investigation commission.
Alongside it, the trade union elects authorised persons or public inspectors in units and shifts. They watch day-to-day conditions, raise problems with management and can make proposals that officials must consider. The Labour Code (Article 239) confirms union control and allows unions to set up legal and technical labour inspections.
Comparison
| Topic | Kyrgyzstan | Türkiye | EU (Directive 89/391/EEC) |
|---|---|---|---|
| Joint committee | Labour protection commission in the organisation, parity, binding decisions (Law No. 82, Art. 17) | OSH committee at 50 or more workers and continuous work longer than 6 months (Law 6331, Art. 22) | Balanced participation and consultation; committees per national law |
| Worker representative | Trade union authorised persons and public inspectors | Worker representative(s) by headcount (Law 6331, Art. 20) | Workers' representatives with specific OSH responsibility |
| Role in accidents | Commission investigates; unions take part | Committee reviews accidents | Consulted, informed of accidents |
Example: A gold processing plant with 300 workers and a sectoral trade union sets up a joint labour protection commission of four management and four union members. The union elects an authorised person for labour protection in each shift. After a conveyor injury, the authorised person of that shift joins the investigation, and the joint commission later checks that the guarding measures in the N-1 act have been completed. The employer pays for the authorised persons' training and gives them paid time for the role as agreed in the collective agreement.
Practical tips for foreign employers
- Ask early whether a sectoral trade union is present on site; contractors often fall under the client's collective agreement arrangements.
- Write the commission's rules (parity membership, meetings, minutes, accident role) and keep minutes for inspectors.
- Give authorised persons time and training; their findings are a cheap early warning.
