Short answer

Group, severe and fatal accidents must be reported immediately to the labour inspection, the prosecutor, the trade union federation and others; a commission investigates within 3 days (minor) or 15 days (special cases). Rules: Law No. 82 of 2026, Resolution No. 64 of 2001.

Every workplace accident must be reported at once to the line manager and the employer, and a group, severe or fatal accident must be reported immediately by the employer to the state labour inspection, the local prosecutor, the territorial trade union federation and other bodies. The rules are in Article 21 of the Law "On Labour Protection" No. 82 of 2026, Article 208 of the Labour Code and the Regulation on investigation and recording of workplace accidents approved by Government Resolution No. 64 of 27 February 2001 (as amended to 5 June 2020).

Short answer

  • First report: the injured worker or a witness tells the work supervisor, who arranges first aid, informs the employer and preserves the scene (Regulation, point 7).
  • Immediate notification: for a group accident (two or more workers), an accident with a severe outcome or a fatal accident, the employer notifies immediately, by telephone or in writing on the prescribed form, the labour inspection, the prosecutor's office, the territorial supervisory body where the site is under its control, the superior body, the territorial trade union federation and the organisation that sent the worker (point 20).
  • Hospitals: health facilities report workers admitted with severe or fatal work injuries to the labour inspection within 24 hours (point 21).
  • Investigation time: minor accidents, an employer commission of at least 3 people within 3 days (point 13); group, severe and fatal accidents, a special investigation within 15 days, normally chaired by a state labour inspector (points 23 to 25).
  • Record: an act on form N-1 for every accident causing at least one day's incapacity or death; one copy to the victim within 3 days of the investigation; the employer keeps the other with the file for 50 years (points 9 and 10).
  • Hazardous facilities: an accident (авария) also needs a technical investigation under Article 12 of Industrial Safety Law No. 160 of 2016.

Step by step after an accident

  1. Care and safety. Give first aid, call emergency services, and make the area safe so that no one else is hurt.
  2. Preserve the scene. Keep the workplace and equipment as they were until the investigation, unless that endangers other workers or causes an accident; record and photograph before anything is moved.
  3. Notify. Inform the employer at once; for a group, severe or fatal accident the employer sends the immediate notices listed above. A hazardous facility operator also reports accidents, incidents and injuries, their causes and the measures taken (Law No. 160, Article 10).
  4. Commission. For a minor accident the employer appoints by order a commission of at least three: the labour protection specialist (who may be engaged under contract), employer and trade union or worker representatives, and the victim's trusted person on request. The manager directly responsible for safety in that unit may not sit on it (point 12).
  5. Special investigation. For group, severe and fatal accidents the commission is normally chaired by a state labour inspector (by the supervisory body at a site it controls, or by the union's technical labour inspector in a unionised organisation) and includes union, superior body, employer and worker members (points 23 to 25). Where 4 or more people die, the head of the labour inspection authority appoints the commission; for a major accident in which 7 or more people are killed, a government commission investigates (points 23, 27 and 28). The employer pays for expert work, tests and photographs.
  6. Record and follow up. The commission establishes the circumstances and causes and decides whether the accident is work-related; the employer issues the N-1 act in Kyrgyz or Russian, registers it in the accident journal and carries out the measures. The chair of a special investigation sends the materials to the prosecutor, the labour inspection, the trade unions and the victim or family within five days (point 34).
  7. Compensation. Chapter 5 of Law No. 82 gives the injured worker, or the family after a death, rights to lost earnings, extra expenses, a lump sum and moral damages.

Accidents at hazardous production facilities

Law No. 160 separates two events that often happen together:

EventDefinition (paraphrased)Investigation
Accident at workInjury, poisoning or death of a worker at workLabour protection procedure (Law No. 82, Article 21; Resolution No. 64)
Accident at a hazardous facility (авария)Destruction or damage of structures or equipment, uncontrolled explosion, fire or release of hazardous substancesTechnical investigation by a special commission led by the industrial safety supervisory body, or a commission formed by the Cabinet (Article 12)
IncidentFailure of technical devices, deviation from the process, breach of the rulesCommission of the operating organisation (Article 12)

The special commission includes state and local authorities, the sectoral trade union and the operator; the operator must give it all information and pays for the investigation.

Example: A gas cylinder explosion at a small gas filling plant injures two operators. Because two workers were hurt, it is a group accident: the employer gives first aid, calls emergency services, isolates the site and immediately notifies the labour inspection, the prosecutor, the trade union federation and the industrial safety body. A special commission completes its investigation within 15 days, with an N-1 act for each victim, while the technical investigation of the explosion runs under Law No. 160.

Common mistakes

  • Waiting for the medical outcome before notifying; notify a group or possibly severe accident immediately and record the time.
  • Using Russian or Kazakh time limits and forms; the Kyrgyz regulation has its own.
  • Closing the case without trade union participation or without giving the victim a copy of the N-1 act.

Note: Law No. 82 gave the Cabinet six months to align its regulations. On 5 November 2026 Resolution No. 64 was still shown as in force in the official database; check for a replacement.
